Custom Jewelry Terms of Purchase

TERMS OF PURCHASE

By clicking “Buy Now,” “Purchase,” or any other phrase on the purchase button, by signing, and/or entering your credit card information, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client” or “You”) agree to be provided with jewelry products by Siyari Jewellers (“Company”), and you are entering into a legally binding agreement with the Company, subject to the following Terms of Purchase:

GENERAL TERMS
Siyari Jewellers will provide jewelry services, including custom-designed pieces, to the Client.
The Client agrees to pay a non-refundable deposit to begin the design process. This deposit will be applied towards the full price of the jewelry.
Siyari Jewellers will provide initial designs along with a full price quote via email. This quote will be valid for fourteen (14) days as metal prices may fluctuate. The Client may provide feedback during the initial consultation, with up to two (2) revisions allowed.
Within fourteen (14) days, the Client must approve the final design, delivery timeline, and payment schedule in writing via email.
If the Client chooses not to proceed with the Jewelry, the non-refundable deposit may be applied towards another product or service.

PAYMENT TERMS
Once the final quote is accepted, sixty percent (60%) of the remaining payment will be due as the first installment. Sales tax and other applicable charges may be included.
Rush fees may apply in certain cases.
The Client agrees to make payments according to the agreed-upon schedule. Even if the process is delayed due to non-communication or lack of Client feedback, all payments must be made on time.
Final payment must be made no later than six (6) weeks after the first installment. If payment is not received on time, Siyari Jewellers reserves the right to pause production and will not complete or deliver the Jewelry until full payment is made.
Custom jewelry is unique, and final pieces may appear slightly different from initial designs. No refunds or returns are permitted on custom jewelry pieces.

CUSTOM DESIGN & CLIENT-PROVIDED STONES
The Client is responsible for providing accurate sizing. A sizing kit may be sent upon request.
If Client feedback is required and there is a delay in response, the delivery schedule may be adjusted accordingly.
Siyari Jewellers may accept Client-provided gemstones on a case-by-case basis. If a pre-owned or pre-purchased stone is used, an assessment will be conducted during the design process.
The Client assumes all risk when mailing or delivering gemstones or jewelry for use in a custom piece. The Company will assess potential risks and advise the Client before resetting stones. By consenting to reset a pre-existing gemstone or refine metal, the Client releases Siyari Jewellers from any claims of damage or liability, including those due to flaws, cracks, chipping, or inclusions discovered during the process.
If agreed upon, refinements of gold or other metals will not be exchanged for cash but may be applied as credit toward other products or services.

DELIVERY AND PICKUP
For Delivery: Siyari Jewellers will ship the final product to the Client’s address upon request, and a signature may be required. The Jewelry will be insured for its full value. If the Jewelry is lost or damaged during delivery, the Client must notify Siyari Jewellers within forty-eight (48) hours of the expected delivery. The Company will work with the Client to repair or replace the item.
For Pickup: In-store pickup is available at the designated Siyari Jewellers showroom. The Client must schedule an appointment for pickup.

REPAIRS & WARRANTY
Clients who purchase jewelry from Siyari Jewellers will receive complimentary repair work for six (6) months for any damages caused under normal wear conditions. This does not cover extreme or unusual damage (e.g., lost in a drain, hit against a hard surface, lost in the sea, run over by a vehicle, etc.). The Company reserves the right to determine the extent of damage and may impose additional fees if necessary.
This warranty does not cover loss or theft of jewelry, including center stones, under any circumstances. If the jewelry has been altered or resized by a third party without express written consent from Siyari Jewellers, the warranty becomes void.
No other warranties, written or oral, apply beyond what is stated in these terms.

RETURN & RESALE POLICY

Returns are not allowed on custom-made jewelry.

 If the Client wishes to exchange or resell a previously purchased item, Siyari Jewellers may deduct making charges and up to 70% of the diamond cost based on current market value and condition.

The resale value is solely determined by Siyari Jewellers.

APPRAISALS AND INSURANCE
Siyari Jewellers will provide a complimentary appraisal of the Jewelry. The Client acknowledges that securing insurance for their Jewelry is their responsibility and should be obtained as soon as possible to protect against loss, theft, or damage.

INTELLECTUAL PROPERTY RIGHTS
Siyari Jewellers retains all copyright and intellectual property rights related to the designs and branding of its jewelry. The Company reserves the right to photograph and use images of the jewelry for promotional and marketing purposes unless the Client revokes this permission in writing.

DISCLAIMERS & RELEASE OF CLAIMS
By purchasing or using jewelry from Siyari Jewellers, the Client acknowledges that the Company is not liable for any direct or indirect adverse effects, damages, or issues arising from the purchase.
Jewelry designs may have natural imperfections or variations, which are not considered defects. The Company cannot guarantee that the final product will be exactly as envisioned.
In no event shall Siyari Jewellers be held liable for any direct, indirect, incidental, or consequential damages, including but not limited to business losses, data loss, or unauthorized use of information.

FORCE MAJEURE
If unforeseeable circumstances beyond the control of either party (e.g., natural disasters, war, pandemics, labor strikes) make it impossible or inadvisable to fulfill obligations, the affected party’s performance will be extended without liability for the delay.

GOOD FAITH
Both parties agree to act in good faith in the negotiation, execution, and fulfillment of this Agreement.

LIMITATION OF LIABILITY
Under no circumstances shall Siyari Jewellers be liable for direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from the purchase or use of jewelry. This includes but is not limited to product defects, payment disputes, third-party issues, or delays in delivery. In no event shall the Company’s total liability exceed the amount paid by the Client for the Jewelry.

DISPUTE RESOLUTION
If a dispute arises, both parties agree to resolve it through good-faith negotiations. If a resolution is not reached, the dispute will be settled through arbitration in Hyderabad, India, within ninety (90) days of the initial arbitration request. Both parties will cooperate in the arbitration process to ensure a timely resolution.

By proceeding with a purchase, the Client acknowledges and agrees to all the above terms and conditions.
